Town Statement - Ontario Land Tribunal Decision Issued on King Street Apartment Application

On April 26, the Ontario Land Tribunal (OLT) issued its decision on the Official Plan Amendment and Zoning By-law Amendment applications for the King Street apartment proposal on the northwest side of King Street, south of Cottage Street in Niagara-on-the-Lake.

The applications were appealed by the applicant on October 27, 2023, for non-decision of Council.

The OLT member has ordered that the appeal is allowed and that the Official Plan and Zoning By-law (with Holding provision) be amended to permit the 3-storey, 17-unit apartment building. The holding provision remains to address stormwater management.

The OLT found that the proposed development aligns with provincial and municipal planning policies by offering various housing options and blending well with the neighbourhood. Taking all factors into account, the Tribunal determined that the applications meet the necessary policies and represent good planning. The OLT decision is final.
